Let's put it in plain english first...
Access to Plaata
We promise to keep access to Plaata data free. In the future we may provide user-paid features or advertising, but we will not restrict or charge you for accessing the Plaata data.
Service
Currently we only charge a fee to sellers, based on the Banknotes they sell. All other services are free of charge. If you don't sell stuff on Plaata, we will not send you a bill. Although we do not foresee changing this policy, we obviously reserve the right to change the terms of service (TOS). We reserve the right to discontinue this service or change any aspect of it, with or without notification to members.
Privacy
We promise not to sell or give out any private information unless you tell us to do so. Currently all lists that can be created in Plaata are public. That said, if we ever roll out features that allow you to create private lists (such as a private wantlist), we will try hard to keep them private. We have great security mechanisms in place, but we don't have an army of DBAs and developers dedicated to security aspects of the site, so we cannot give an absolute 100% guarantee of privacy (wouldn't that violate the third law of thermodynamics anyways? Oh well...).
If you are extremely jealous about your collectionsb, wantlists, etc, and public exposure would mean the end of the universe, we recommend not to post such information online.
We use cookies to make your life easier, such as accessing pages. Don't panic, they mean no harm.
Spam, emails, etc
We will not send you mass email or spam without your consent. Keep in mind that certain transactions (such as buying or selling) generate automated notifications.
Forums and other Messaging
Be nice. Think twice before you post something. As soon as your thoughts are posted online they will be recorded somewhere forever, until the sun becomes a red giant, so exercise civility and don't do stupid things such as posting sensitive or personal information about your neighbor.
About that Liability thing...
Plaata shall not be liable to a user or member in case we exercise any of the rights mentioned in this TOS. All users are solely responsible for their actions when using this service. In other words, you will not sue us, we have no money anyways.
You will not hold Plaata responsible for other users' content, actions or inactions. We are not an auction site or a store and we are not involved in the actual transactions between buyers and sellers. We do have mechanisms in place for users to report items or actions that may breach the TOS but we do not monitor or moderate all content that is posted. As such, we cannot guarantee the quality, safety or legality of items or content advertised, the truth or accuracy of users’ content or listings, the ability of sellers to sell items, the ability of buyers to pay for items, or that a buyer or seller will actually complete a transaction.
When you become a Plaata member you will receive a user account and a password. Needless to say, you are entirely responsible for keeping your password confidential!
Violations
To report violations of the TOS, please use the report problem form (help menu). To expedite the processing of your report, please include as many details as possible about the violation.
In the Banknote details page, users can report a Banknote that is considered offensive in nature.
We are nice people and really want you to enjoy this site, but we need to play bad cop (or bad lawyer) for a little while, so by becoming a member you also agree with the following:
ACKNOWLEDGMENT AND ACCEPTANCE OF TERMS OF SERVICE
Plaata.com ("Plaata", the "Service"), owned and operated by Hobbista, LLC. ("Hobbista"), is provided to you ("Users", "User", "Member", "Members") under these Terms of Service (TOS) and any operating rules or policies that may be published by Plaata. The TOS comprises the entire agreement between Member and Plaata and supersedes all prior agreements between the parties regarding the subject matter contained herein. BY USING THE Plaata WEBSITE, YOU ARE INDICATING YOUR AGREEMENT TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS OF THE TOS.
You Expressly Understand and Agree That:
A.) Your use of our service is at your sole risk. The service is provided on an "as is" and "as available" basis. Plaata expressly disclaims all warranties of any kind, whether expressed or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non -infringement.
B.) Plaata makes no warranty that (i) the service will meet your requirements, (ii) the service will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the service will be accurate or reliable, (iv) the quality of any products, services, information, or other material purchased or obtained by you through the service will meet your expectations, (v) any errors in the software will be corrected, (vi) or that this web site, its content, and the servers on which the web site and content are available are free of viruses or other harmful components.
C.) Any material downloaded or otherwise obtained through the use of the service is done at your own discretion and risk and that you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material.
D.) No advice or information, whether oral or written, obtained by you from Plaata or through or from the service shall create any warranty not expressly stated in the TOS.
E.) This web site may contain various combinations of text, images, audiovisual productions, opinions, statements, facts, articles, or other information created by Plaata or by third parties. Due to the number of sources from which content in this site is obtained, and the inherent hazards of electronic distribution, there may be delays, omissions or inaccuracies in such content. Accordingly, such content is for your reference only and should not be relied upon by you for any purpose.
F.) Information created by third parties that you may access on the site or through links is not adopted or endorsed by Plaata and remains the Responsibility of such third parties.
G.) Plaata does not promote or condone any ideas or messages contained in the content listed via the service.
Limitation of Liability
H.) You expressly understand and agree that Plaata shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Plaata has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the service; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the service; or (v) any other matter relating to the service.

Member Conduct
L.) Member is solely responsible for the contents of his or her transmissions through the service. Member's use of the service is subject to all applicable local, state, national and international laws and regulations.
Member agrees: (1) to comply with US law regarding the transmission of technical data exported from the United States through the service; (2) not to use the service for illegal purposes; (3) not to interfere or disrupt networks connected to the service; and (4) to comply with all regulations, policies and procedures of networks connected to the service.
The service makes use of the internet to send and receive certain messages; therefore, member's conduct is subject to internet regulations, policies and procedures. Member will not use the service for chain letters, junk mail, spamming or any use of distribution lists to any person who has not given specific permission to be included in such a process.
Member agrees not to transmit through the service any unlawful, harassing, libelous, abusive, threatening, or harmful material of any kind or nature. Member further agrees not to transmit any material that encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state, national or international law or regulation. Attempts to gain unauthorized access to other computer systems are prohibited.
Member shall not interfere with another member's use and enjoyment of the service or another entity's use and enjoyment of similar services. Plaata may, at its sole discretion, immediately terminate service should member's conduct fail to conform with these terms and conditions of the TOS.
Marketplace Release
M.) We are not involved in the actual transaction between Buyer and Seller, and we have no control over the quality, safety or legality of the items listed, or the transactions. We are not a guarantor of any transaction nor are we an escrow company. Therefore, in the event that you have a dispute with one or more members, you release Plaata and our parent, officers, directors, agents, subsidiaries, legal representatives and employees from claims, demands and damages of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.
Termination
N.) You agree that Plaata, in its sole descretion, may terminate your password or account, and remove and discard any content within the service, for any reason, including and without limitation, the lack of use, or if Plaata finds that you have violated or acted inconsistently with the letter or spirit of the TOS. You agree that any termination of your access to the service under any provision of this TOS may be effected without prior notice, and acknowledge and agree that Plaata may immediately deactivate or delete your Plaata account and any or all related information and files. Plaata reserves the right to bar any further access to such files or the service. You agree that Plaata shall not be liable to you or any third-party for any termination of your access to the service.
Should member object to any terms and conditions of the TOS or any subsequent modifications thereto or become dissatisfied with the service in any way, member's only recourse is to immediately discontinue use of the service. Upon termination of the service, member's right to use the service and software immediately ceases. Member shall have no right and Plaata will have no obligation thereafter to forward any unread or unsent messages to member or any third party.
Limitation of Liability.
O.) Under no circumstances will Plaata be liable to you for any indirect, incidental, consequential, special or exemplary damages arising out of or in connection with use of the service whether or not Plaata has been advised of the possibility of such damages. Under no circumstances shall Plaata be liable to you for any amount for services rendered or information provided pursuant to this agreement, rather your sole and exclusive remedy shall be the refund of fees actually paid by you to Plaata for any instance of use of the services that gives rise to a claim. To the extent that any question, comment, or answer refers to any product, manufacturer, distributor, company, service or service provider, Plaata expressly disclaims any association with, endorsement of or liability for any such product, manufacturer, distributor, company, service or service provider.
Children Prohibited
P.) The children's online privacy protection act (coppa) severely restricts what information can be collected from children under 13. For this reason, children under 13 are prohibited from using Plaata. Children 13 and over may participate with the permission and guidance of their parent or guardian. Users of all ages are warned not to provide profile information without weighing the risks and benefits, and never to provide their phone number, address or other critical personal data on-line.
